David S. Warner
Overview
David Warner practices principally in the area of public agency law, specializing in land use, labor and employment, solid waste, and public finance matters. He is actively involved in the general representation of North Bay municipalities and special districts and is fully conversant in the daily operations and legal needs of local governments. His experience in development matters for both public and private clients is extensive; from drafting comprehensive and special zoning regulations, development agreements, and various types of affordable housing agreements to providing advice on land use entitlements, historic preservation laws, and development fees and exactions.
David is fully conversant in a wide-range of matters governing local government operations including revenue and taxation, pension systems, elections, ethics, and public contracts. He is currently advising a number of large municipalities on the discretionary authority of city councils and retirement boards to administer pension and retiree health benefits and questions involving vested rights. He is also actively involved with a Bay Area JPA and local city on the interpretation and amendment of solid waste franchise agreements. As a member of the firm's First Amendment working group, David also regularly advises municipal clients on the permitting and use of public spaces, the zoning and licensing of certain types of businesses, and the regulation of signage.
David previously represented public agencies in the Bay Area before joining the partnership of a Chicago-based law firm where he continued his government and land use practice on behalf of both public and private clients. He has authored articles on vested rights and land use issues and served as Adjunct Professor at the University of San Francisco teaching administrative law. He also previously served as general counsel to the Redevelopment Association of Nevada.
After graduating from UCLA School of Law, David initially worked for Arthur Andersen and KPMG advising corporations, partnerships and high-wealth individuals on tax compliance and planning. He also spent three years at the National Archives and Records Administration where he administered the private donation and deeds of gift program for Office of Presidential Libraries.
David lives in Santa Rosa with his wife and six children.
