Advanced Topics in Leaves of Absence

Meyers Nave invites you to view our previously recorded webinar “Advanced Topics in Leaves of Absence” with Principal and Chair of the Labor and Employment Practice, Gina Roccanova.

Managing employee leaves of absence is one of the most difficult and complicated tasks that managers and human resources professionals encounter. The “alphabet soup” of laws – the FMLA, CFRA, PDL, ADA, FEHA, PFL, USERRA, and others – all impose different requirements on employers. Internal policies, merit system rules, and collective bargaining agreements create additional layers of complexity. How do you navigate these various requirements and still get the work done?

Ms. Roccanova has been advising employers on leave of absence issues since soon after the Department of Labor published its first set of FMLA regulations in 1995. Since that time, she has counseled, trained, and litigated these issues on behalf of public and private sector clients. She has also drafted regulations, legislation, and internal policies regarding leaves of absence. Her pragmatic approach stems not only from her extensive body of legal knowledge, but also from her own experience as a manager.

The webinar draws on Ms. Roccanova’s experience as a litigator, counselor, and manager to cover:

  • A review of laws governing leaves of absence
  • The distinction between sources of time and sources of pay
  • How to determine which laws apply
  • Strategies for managing intermittent leaves
  • Managing risks associated with terminating employees who are on leave or have taken leave
