Defending Against Construction Contractor Claims

County Counsels' Association members are invited to join Ben Reyes, Chair of Meyers Nave’s Public Contracts Practice Group, for a presentation on “Defending Against Construction Contractor Claims” at the Public Works and Contracts Spring Study Section Conference.

On public works projects, disagreements between the contractor and the public agency/owner often occur regularly, particularly on major projects which are seldom completed on-budget and on-time. Public works projects tend to experience substantial change orders which frequently develop into construction claims both during and at the end of the project, and might result in litigation. The claims include additional work claims, unforeseen site condition claims, and delay and impact claims. The session will address how to evaluate the most frequent types of claims, provide insight on risk management strategies, and explain different resolution approaches including negotiating, mediating and litigating. The session will also cover steps that can be taken to manage the time and costs of defending construction contractor claims.
