Down the Rabbit Hole: When Disability Leave Laws Collide

Employee medical leave requests present a host of challenges for employers, not the least of which is determining which leave laws apply. Laws like the Family Medical Leave Act require employers to provide a specific number of weeks, while others like the Americans with Disabilities Act require reasonable accommodation of disabilities, with courts stating that temporary leave can at times be a reasonable accommodation.  Add to the mix the obligation to provide pregnancy disability and childbirth leave and public employers’ obligations under the Public Employees’ Retirement Law and under internal personnel rules, and human resource representatives can find themselves tumbling down the rabbit hole as they attempt to sort through leave requests.
