Workplace Investigations: Fundamentals, New Case Law and Emerging Issues

Please join Camille Hamilton Pating, the leader of Meyers Nave’s statewide Workplace Investigations Team, for her presentation at the Annual Conference of the International Municipal Lawyers Association on September 30 in San Diego.

Investigating allegations of workplace misconduct by public sector employees involves unique procedural and substantive considerations, as well as complex challenges that are presented by high-profile situations when the subject is an elected official, City Council or Board member, law enforcement personnel, department manager or other high-ranking public official.

In addition to addressing the fundamentals of workplace investigations, expert investigator Camille Hamilton Pating will cover a comprehensive range of current and emerging issues, including:

  • Confidentiality during and after an investigation
  • Privacy questions regarding employees’ personal social media accounts
  • Attorney-client privilege after City of Petaluma v. Superior Court of Sonoma County
  • Potential employer liability for inadequate, discriminatory, retaliatory and/or negligent investigations, as well as consequences of failing to take corrective action after an investigation
